2.  (U) At paragraph 3 is the text of the U.S. Delegation 
Paper entitled "U.S. Response to Russian Aide-Memoire dated 
March 10, 2009" that was provided to the Russian Delegation 
at the Heads of Delegation Meeting on Courtland Missile 
Assembly Facility and RS-24 New Type, held at the U.S. 
Mission, on June 10, 2009.

  U.S. Response to Russian Aide-Memoire Dated March 10, 2009 
 
     The United States has studied the discussions from 
JCIC-XXXIII and the Russian aide-memoire dated March 10, 2009 
and believes solutions exist for all four of the issues 
raised in the aide-memoire.  Three of the issues will be 
addressed in this delegation paper.  The U.S. response to the 
fourth issue, conversion of the B-1 heavy bomber to a heavy 
bomber equipped for non-nuclear armaments is the subject of a 
separate paper and has been provided in capitals. 
 
     On the demonstration of the Minuteman III ICBM front 
section, the United States has determined that it can support 
such a request by the other Parties.  A one-time 
demonstration will be organized and conducted outside of any 
inspection quotas established in the Treaty.  We will inform 
you of the date through Diplomatic channels. 
 
     On U.S. activities at the Courtland Missile Assembly 
Facility, the United States confirms that activities 
conducted at the Courtland Missile Assembly Facility are in 
compliance with Treaty requirements.  Trident I SLBM first 
stage motors are brought to the Courtland facility to undergo 
activities that are consistent with work done at production 
facilities, including assembly of Trident I SLBM first 
stages.  Trident I SLBM first stages assembled at the 
Courtland facility will be incorporated into LV-2 space 
launch vehicles, which will begin exiting the Courtland 
facility in the near future. 
 
     The LV-2 space launch vehicle will initially be used as 
a target vehicle for testing of the U.S. ballistic missile 
defense system and other uses consistent with the START 
Treaty are possible.  These space launch vehicles will be 
accountable under the START Treaty as Trident I SLBMs 
because, in the case of a Trident I SLBM, it is the first 
stage that is the item of accountability in accordance with 
Article III, paragraph 3(a). 
 
     All required Treaty notifications will be provided and 
launch of the space launch vehicle will occur from facilities 
declared under the START Treaty.  LV-2 technical information 
required by Joint Statements 21 and 31 was provided to the 
other parties in April 2009. 
 
     With regard to the Russian Federation question on what 
 
 
Russian inspectors should do if this item is encountered, 
Russian inspectors will account for it as a Trident I first 
stage. 
 
     On the re-declaration of Peacekeeper ICBM silo launchers 
as Minuteman III ICBM silo launchers, a START format 143 
notification was transmitted June 4, 2009 that rescinded this 
re-declaration.  The United States will provide the 
appropriate information in the next six-month update to the 
Memorandum of Understanding and considers this issue to be 
resolved.
