ORGANIZTION (FAO) COUNCIL'S 123RD SESSION (OCTOBER 28- 
OVEMBER 2), THE U.S. DELEGATION WAS SUCCESSFUL IN 
ENSURING THAT THE TERMS OF REFERENCE OF AN INTERSSSIONAL 
"FRIENDS OF THE CHAIR" GROUP ON DIRECTOR ENERAL TERM 
LIMITS DID NOT PREJUDGE THE OUTCOME F THE GROUP'S 
DELIBERATIONS.  USDEL HAD SOME SUCESS IN SHAPING THE 
TERMS OF REFERENCE OF THE INTRGOVERNMENTAL WORKING GOUP 
ON THE PROGRESSIVE RELIZATION OF THE RIGHT TO FOOD, 
PARTICULARLY IN ENURING THAT THE FAO (RATHER THAN THE

PREPARE A NEW DRAFT.  THE REDRAFT INCLUDED SOME U.S. 
SUGGESTIONS (IN PARTICULAR, TO HOLD OFF ACTUALLY DRAFTING 
GUIDELINES UNTIL THE THIRD SESSION OF THE WORKING GROUP) 
BUT INCLUDED A NEW EU PROPOSAL WHICH WOULD HAVE GIVEN THE 
OFFICE OF THE HIGH COMMISSIONER ON HUMAN RIGHTS AN EQUAL 
SAY IN SETTING THE AGENDA AND WORK PROGRAM FOR THE GROUP. 
IN A SUBSEQUENT SMALL MEETING USDEL WAS ABLE TO DELETE 
THE HUMAN RIGHTS REFERENCE, BUT OTHER ASPECTS OF THE 
TERMS OF REFERENCE (INCLUDING UNCLEAR DEVIATIONS FROM THE 
RULES OF PROCEDURE OF THE COMMITTEE ON WORLD FOOD 
SECURITY) MAY COMPLICATE THE WORK OF THE IGWG. (COMMENT: 
THE EU CAME TO THE COUNCIL UNPREPARED AND UNWILLING TO

9.  THE 123RD COUNCIL PROVIDED THE FIRST OPPORTUNITY FOR 
COUNCIL TO REVIEW THE FAO'S MEDIUM TERM PLAN (MTP) FOR 
2004-2009.  THE COUNCIL ENDORSED THE SUBSTANTIVE CONTENT 
OF THE MTP AS A BASIS FOR PREPARATION OF THE PROGRAM OF 
WORK AND BUDGET FOR THE NEXT BIENNIUM TAKING INTO 
ACCOUNTS THE COMMENTS OF THE PROGRAM AND FINANCE 
COMMITTEES AND THE RESULTS OF THE UPCOMING TECHNICAL 
COMMITTEES (COFI, COFO, COAG).  THE MTP PROPOSES AN 
INCREASE IN THE BUDGET LEVEL BY MORE THAN FIFTEEN PERCENT 
OVER THE SIX-YEAR PERIOD AND EVEN GREATER INCREASES FOR 
SPECIFIC PROGRAMS, NOTABLY THE TECHNICAL COOPERATION 
PROGRAM.  CONCERNING THE BUDGET LEVEL, USDEL STATED THAT 
THE UNITED STATES CONTINUED TO SUPPORT ZERO NOMINAL 
GROWTH.  USDEL AND OTHER GENEVA GROUP MEMBERS STATED

THE MTP PERIOD) WAS "NOT OUTRAGEOUS."

APPROVED PROGRAM OF WORK TO THE MAXIMUM EXTENT POSSIBLE 
FROM THE EFFECTS OF FLUCTUATING CURRENCIES. THE AFRICAN 
REGIONAL GROUP SUPPORTED U.S. OPPOSITION TO A SPLIT 
ASSESSMENT.  THE COUNCIL ALSO AGREED THAT A DECISION ON 
THIS MATTER NEEDED TO BE TAKEN BEFORE THE NEXT

BE THE SUBJECT OF REGIONAL GROUP CONSULTATIONS BETWEEN 
NOW AND THE NEXT COUNCIL.  (COMMENT: ALTHOUGH JAPAN'S 
CONTRIBUTION TO THE FAO BUDGET IS SECOND ONLY TO THE 
UNITED STATES', THE ASIA REGIONAL GROUP DOES NOT BELIEVE 
JAPAN'S VIEWS REPRESENT THOSE OF THE GROUP AS A WHOLE. 
THEY HAVE THEREFORE NOT BEEN WILLING TO GUARANTEE JAPAN 
ONE OF ASIA'S TWO SEATS ON THE FINANCE COMMITTEE NOR 
REPRESENTATION IN OTHER FAO BODIES. JAPAN IS SEEKING AN 
INCREASE IN THE NUMBER OF MEMBER COUNTRIES ALLOWED IN FAO 
FINANCE AND PROGRAM COMMITTEES TO OVERCOME THIS PROBLEM.

15.  THE COUNCIL CHAIR DISCUSSED THE TERMS OF REFERENCE 
OF A PROPOSED INTERSESSIONAL "FRIENDS OF THE CHAIR" GROUP 
ON DIRECTOR GENERAL TERM LIMITS WITH THE EXPANDED BUREAU 
AND REGIONAL CHAIRS OVER THE COURSE OF THE WEEK.  IN THE 
FINAL AGREED TERMS OF REFERENCE, THE GROUP OF "FRIENDS" 
WILL EXAMINE THE NUMBER OF TERMS ALLOWED, BUT ALSO THE 
LENGTH OF TERMS AND WHEN LIMITS WOULD TAKE EFFECT.  THE G- 
77 ORIGINALLY SOUGHT LANGUAGE TO ENSURE THAT THE 
INCUMBENT WOULD BE EXEMPTED FROM ANY CHANGES TO THE FAO 
CONSTITUTION.  ALTHOUGH THE EU MEMBERS OF THE EXPANDED 
BUREAU WERE WILLING TO ACCEPT THIS "GRANDFATHERING" 
CLAUSE, U.S., CANADIAN AND AUSTRALIAN UNWILLINGNESS TO 
GIVE IN RESULTED IN A MUCH IMPROVED TERMS OF REFERENCE 
WHICH DOES NOT PREJUDGE THE OUTCOME AS FAR AS THE 
INCUMBENT.  THE TERMS OF REFERENCE DO STATE, HOWEVER, 
THAT THE "RIGHTS AND OBLIGATIONS" OF THE INCUMBENT WILL 
BE A SUBJECT FOR DISCUSSION IN THE WORKING GROUP.

HIS ABSENCE.  NOT SURPRISINGLY, THE FIRST SESSION OF THE 
"FRIENDS OF THE CHAIR MEETING" (HELD ON NOVEMBER 1) DID 
NOT REACH ANY CONCLUSIONS.  COMMENT:  THE EU WAS WILLING 
TO CONCEDE THE POINT ON GRANDFATHERING THE INCUMBENT IN 
PART BECAUSE, ACCORDING TO A 1998 EU DIRECTIVE, NONE OF 
THEM CAN SUPPORT A CANDIDATE WHO HAS SERVED TWELVE YEARS 
OR MORE AS DIRECTOR GENERAL.  THEY BELIEVE THAT IF THE 
CURRENT DG WERE TO RUN FOR REELECTION IN 2005 AND DID NOT 
RECEIVE ANY SUPPORT FROM DONOR COUNTRIES, EVEN IF HE 
COULD MUSTER ENOUGH VOTES FROM THE G-77 TO WIN, HE WOULD 
NOT HAVE A MEANINGFUL MANDATE TO RUN THE FAO.  WE BELIEVE 
THAT BEHIND THE SCENES, THE DG ACTUALLY ENCOURAGED THIS 
DISCUSSION TO TAKE PLACE SO HE COULD TEST THE LIMITS OF

IMPORTANT REFORM ITEM ON THE (REVISED) AGENDA. FAO 
MEMBERS HAVE AT HAND ONE OF THE MOST SIGNIFIANT 
OPPORTUNITIES IN THE LAST THREE DECADES TO BING MUCH- 
NEEDED REFORM TO THE FAO AS AN INSTITUION AND MAKE 
CONCRETE STEPS TOWARDS ENSURING THA THE ORGANIZATION IS 
DYNAMIC AND ACCOUNTABLE. INERSESSIONAL WORK ON THIS 
ISSUE WILL BE CRITICAL I BRINGING A BROADLY-SUPPORTED
