¶1. SUMMARY: DURING THE UN FOOD AND AGRICULTURE
ORGANIZTION (FAO) COUNCIL'S 123RD SESSION (OCTOBER 28-
OVEMBER 2), THE U.S. DELEGATION WAS SUCCESSFUL IN
ENSURING THAT THE TERMS OF REFERENCE OF AN INTERSSSIONAL
"FRIENDS OF THE CHAIR" GROUP ON DIRECTOR ENERAL TERM
LIMITS DID NOT PREJUDGE THE OUTCOME F THE GROUP'S
DELIBERATIONS. USDEL HAD SOME SUCESS IN SHAPING THE
TERMS OF REFERENCE OF THE INTRGOVERNMENTAL WORKING GOUP
ON THE PROGRESSIVE RELIZATION OF THE RIGHT TO FOOD,
PARTICULARLY IN ENURING THAT THE FAO (RATHER THAN THE
OFFICE OF TH HIGH COMMISSIONER FOR HUMAN RIGHTS) HAS THE
LEA IN SERVICING THE GROUP. THE COUNCIL ADOPTED A

EVISED CODE OF CONDUCT ON THE DISTRIBUTION AND USEOF
PESTICIDES; THE UNITED STATES DID NOT BLOCK COSENSUS,
BUT REGISTERED STRONG DISAPPOINTMENT THAT THE COUNCIL WAS
ADOPTING A CODE WHICH DID NOT COMMAND INDUSTRY SUPPORT.
ON PROGRAM AND BUDGET ISSUES, AUSTRALIA, SUPPORTED BY THE
U.S., TOOK THE LEAD IN ENSURING THAT THE COUNCIL
RECOGNIZED THE NEED TO ENSURE FUNDING FOR INTERNATIONAL
PLANT PROTECTION CONVENTION ACTIVITIES SO THAT FOUR
STANDARDS A YEAR COULD BE COMPLETED. COUNCIL MEMBERS
GREETED AMBASSADOR HALL'S ANNOUNCEMENT OF U.S. SIGNING OF
THE TREATY ON INTERNATIONAL LANT GENETIC RESOURCES WITH
ENTHUSIASTIC APPLAUS. IMPORTANT WORK AHEAD INCLUDES
SUBMITTING U.S. VIEWS ON VOLUNTARY GUIDELINES ON THE
RIGHT TO FOOD FOR THE FIRST SESSION OF THE WORKING GROUP
AND WORKING WITH THE FRIENDS OF THE CHAIR TO FIND A
SATISFACTORY FORMULATION ON TERM LIMITS FOR SUBMISSION TO

SURPRISING SINCE GERMANY IS PAYING FOR THE SECRETARIAT

PREPARED TO ACCEPT THE REVISED TEXT AS PRESENTED. END
COMMENT). AT THE U.S. INITIATIVE, A SMALLER GROUP MET TO
DISCUSS OPTIONS. DURING THIS MEETING ARGENTINA PROPOSED
DELETING ARTICLES 6.1.7 AND 6.1.8. THE EU SUBSEQUENTLY
NOTIFIED USDEL THAT THEY COULD ACCEPT THE REVISED CODE
WITH THE PROPOSED DELETION. PER INSTRUCTIONS, USDEL DID

AND PENDING THE VIEWS OF THE FAO COMMITTEE ON
AGRICULTURE. THE MATTER WILL BE TAKEN UP AGAIN AT THE

¶9. THE 123RD COUNCIL PROVIDED THE FIRST OPPORTUNITY FOR
COUNCIL TO REVIEW THE FAO'S MEDIUM TERM PLAN (MTP) FOR
2004-2009. THE COUNCIL ENDORSED THE SUBSTANTIVE CONTENT
OF THE MTP AS A BASIS FOR PREPARATION OF THE PROGRAM OF
WORK AND BUDGET FOR THE NEXT BIENNIUM TAKING INTO
ACCOUNTS THE COMMENTS OF THE PROGRAM AND FINANCE
COMMITTEES AND THE RESULTS OF THE UPCOMING TECHNICAL
COMMITTEES (COFI, COFO, COAG). THE MTP PROPOSES AN
INCREASE IN THE BUDGET LEVEL BY MORE THAN FIFTEEN PERCENT
OVER THE SIX-YEAR PERIOD AND EVEN GREATER INCREASES FOR
SPECIFIC PROGRAMS, NOTABLY THE TECHNICAL COOPERATION
PROGRAM. CONCERNING THE BUDGET LEVEL, USDEL STATED THAT
THE UNITED STATES CONTINUED TO SUPPORT ZERO NOMINAL
GROWTH. USDEL AND OTHER GENEVA GROUP MEMBERS STATED

SUBSEQUENT INTERVENTIONS, THE LATIN AMERICAN GROUP

PROGRAM, BUDGET AND EVALUATION RESPONDED THAT THE MTP
PROVIDED MEMBERS WITH THE DIRECTOR GENERAL'S VIEW OF WHAT
WAS NEEDED TO RESPOND TO THE DEMANDS PLACED ON THE
INSTITUTION AND DISCOURAGED THE NOTION OF PROVIDING
ALTERNATE SCENARIOS, PARTICULARLY IN VIEW OF THE FACT
THAT THE PROPOSED INCREASE (2.25 PERCENT PER YEAR OVER
THE MTP PERIOD) WAS "NOT OUTRAGEOUS."
¶10. UNDER DISCUSSION OF THE MEDIUM TERM PLAN THE U.S. AND
CAIRNS GROUP COUNTRIES (LED BY AUSTRALIA) EXPRESSED
STRONG SUPPORT FOR THE ACTIVITIES OF THE INTERNATIONAL
PLANT PROTECTION CONVENTION SECRETARIAT. THE COUNCIL
REPORT STATES THAT THE COUNCIL CONCURRED WITH THE

COMMITTEE. THE WEAKENING IN THE FAO FINANCIAL SITUATION
CAUSED BY ARREARS AND INVESTMENT LOSSES CONCERNED MANY
MEMBERS. THE SECRETARIAT NOTED THAT THE RECENT U.S.
CONTRIBUTION OF USD 65 MILLION OBVIATED THE NEED TO
BORROW EXTERNALLY IN THE LAST QUARTER. USDEL STATED THAT

THE U.S. OBJECTIVE WAS TO PAY ITS ARREARS IN FULL BY THE

REPLENISH ITS WORKING CAPITAL AND SPECIAL RESERVE FUNDS
AND TO PROCEED WITH IMPLEMENTATION OF NEXT PHASE OF THE
ORACLE (INFORMATION HANDLING) PROJECT, POSSIBLY WITH SOME
FUNDS LEFT OVER. (COMMENT: PAYMENT OF OUR ARREARS WILL
REMOVE A LONG-STANDING SORE POINT WITH OTHER DONORS AND
ENHANCE U.S. INFLUENCE IN THE FAO. END COMMENT).

¶15. THE COUNCIL CHAIR DISCUSSED THE TERMS OF REFERENCE
OF A PROPOSED INTERSESSIONAL "FRIENDS OF THE CHAIR" GROUP
ON DIRECTOR GENERAL TERM LIMITS WITH THE EXPANDED BUREAU
AND REGIONAL CHAIRS OVER THE COURSE OF THE WEEK. IN THE
FINAL AGREED TERMS OF REFERENCE, THE GROUP OF "FRIENDS"
WILL EXAMINE THE NUMBER OF TERMS ALLOWED, BUT ALSO THE
LENGTH OF TERMS AND WHEN LIMITS WOULD TAKE EFFECT. THE G-
77 ORIGINALLY SOUGHT LANGUAGE TO ENSURE THAT THE
INCUMBENT WOULD BE EXEMPTED FROM ANY CHANGES TO THE FAO
CONSTITUTION. ALTHOUGH THE EU MEMBERS OF THE EXPANDED
BUREAU WERE WILLING TO ACCEPT THIS "GRANDFATHERING"
CLAUSE, U.S., CANADIAN AND AUSTRALIAN UNWILLINGNESS TO
GIVE IN RESULTED IN A MUCH IMPROVED TERMS OF REFERENCE
WHICH DOES NOT PREJUDGE THE OUTCOME AS FAR AS THE
INCUMBENT. THE TERMS OF REFERENCE DO STATE, HOWEVER,
THAT THE "RIGHTS AND OBLIGATIONS" OF THE INCUMBENT WILL
BE A SUBJECT FOR DISCUSSION IN THE WORKING GROUP.
